U.S. District Court Awards 10x Genomics Permanent Injunction in Patent Infringement Lawsuit Against Bruker Corporation's GeoMx Products

On December 23, 2024, the U.S. District Court for the District of Delaware issued a ruling in the patent infringement case between NanoString, a Bruker business, and 10x Genomics. The Court upheld a jury’s damages award of approximately $31.6 million, plus interest and a damages true-up for GeoMx sales since November 2023. The Court stated it would grant 10x Genomics’ request for an injunction against GeoMx products in the United States. This injunction includes a carve-out allowing sales of consumables to the installed base of GeoMx customers existing as of the November 2023 verdict, enabling them to complete ongoing research. Bruker Corporation expressed disagreement with the decision to grant an injunction for sales to new customers in the United States and stated its intention to promptly seek a stay of any finally ordered injunction. Bruker also plans to appeal the case to the U.S. Court of Appeals for the Federal Circuit, maintaining its view that the asserted patents are invalid. GeoMx instrument revenue represents less than 0.2% of Bruker's total revenue, and the CosMx and nCounter product lines are not impacted.
