Munich Regional Court granted InterDigital an injunction against The Walt Disney Company on 2025‑11‑03 for alleged infringement of a patent that covers a method for dynamically overlaying a second video stream onto a primary stream, a technique used for ads, subtitles and interactive content.
The injunction bars Disney from using the patented technology in its streaming services, including Disney+, Hulu and ESPN+. Disney has the right to appeal the decision.
InterDigital has pursued litigation in Brazil, the United States and the Unified Patent Court. A similar preliminary injunction was granted in Brazil earlier this year. InterDigital’s Chief Legal Officer Josh Schmidt said the company seeks fair compensation for its innovations and urges Disney to license the technology.
Disney’s streaming segment generated approximately $25 billion in revenue in 2024, with Disney+ reporting 120 million subscribers and Hulu 20 million. The injunction could require Disney to modify its infrastructure or negotiate a license, potentially affecting ad‑supported revenue streams.
The ruling signals a broader enforcement of streaming‑technology patents and may prompt other providers to review licensing agreements. A settlement between the parties is considered likely given the pattern of rulings.
