enCore Energy Corp. announced on September 16, 2025, that the U.S. Environmental Protection Agency’s Environmental Appeals Board fully denied a petition challenging the company’s Underground Injection Control (UIC) permits for its 100%-owned Dewey Burdock In-Situ Recovery Uranium Project in South Dakota. This decision concludes more than a decade of permitting and litigation.
The denial of the petition clears the final federal regulatory hurdle for the Dewey Burdock Project, allowing enCore Energy to advance to state-level permitting ahead of schedule. This is a critical step for the project, which is designed to recover uranium from subsurface sandstone ore bodies using ISR technology.
The Dewey Burdock Project had previously received its Source and Byproduct Materials License in 2014 from the Nuclear Regulatory Commission and was approved for inclusion in the Fast-41 Program on September 2, 2025. This latest development further de-risks the project and supports its progression towards development and operation.
