The lawsuit, filed in the United States District Court for the Southern District of Iowa, alleged that Albaugh infringed on FMC's U.S. patent rights for manufacturing processes of chlorantraniliprole.
As part of the agreement, Albaugh has agreed to pay FMC for a license to FMC's patented technology used in the manufacture of chlorantraniliprole for agricultural uses in the United States. This settlement recognizes the value of FMC's process patents and allows the company to protect its investment in the discovery and development of chlorantraniliprole.
FMC maintains an extensive patent estate for its chlorantraniliprole technology globally, including in the U.S., China, and India. The company markets several products containing this active ingredient, such as Altacor, Coragen, Elevest, Prevathon, and Vantacor insect control. The settlement ensures continued availability of the product to growers while upholding intellectual property rights.
