Northern Dynasty Minerals Ltd. and its U.S. subsidiary Pebble Limited Partnership announced that the company’s lawsuit in the U.S. District Court for the District of Alaska will resume now that the federal government has reopened following the 43‑day shutdown that ended on November 12, 2025.

The litigation, which was paused during the shutdown, seeks to overturn the Environmental Protection Agency’s 2023 veto of the Pebble copper‑gold‑molybdenum‑silver‑rhenium project in southwest Alaska. The company’s dual‑track strategy involves both legal action and ongoing settlement discussions with the EPA, a path it has pursued since the veto was issued in January 2023.

Northern Dynasty’s filings argue that the veto violated federal statutes, exceeded the EPA’s jurisdiction under the Clean Water Act, and contradicted findings in the Army Corps of Engineers’ environmental impact statement. The company has also filed a takings claim, asserting that the veto constitutes an unconstitutional seizure of property without just compensation.

Financially, the company reported a net loss of $10.9 million for the third quarter of 2025, underscoring the fiscal pressure that accompanies its prolonged legal battle. Management has emphasized that the Pebble Project remains a strategic asset, potentially providing a domestic source of critical metals essential for U.S. technology and green‑energy sectors.

CEO Ron Thiessen stated that the court’s decision to resume proceedings signals that the legal challenge remains active and that the company is prepared to pursue all available avenues to overturn the veto. He added that the company remains optimistic that a settlement or a favorable ruling could unlock the project’s development potential.

The resumption of litigation follows the federal government’s reopening after the shutdown, which had halted many court proceedings. By restarting the case, Northern Dynasty aims to maintain momentum in its regulatory fight while continuing to negotiate with the EPA, thereby keeping the project’s future on the table for U.S. critical‑metal supply chains.
