Oatly Group AB faced a legal setback as the Court of Appeal in London ruled that the company cannot use its 'Post Milk Generation' trademark on product packaging. This decision overturns a previous High Court ruling that had sided with Oatly.

The legal dispute originated from Dairy UK, the trade association for the UK dairy industry, which argued that using the word 'milk' for non-mammary secretions was unlawful. The Intellectual Property Office initially declared the trademark invalid in January 2023, a decision that has now been reinstated.

This ruling impacts Oatly's branding and marketing efforts in the UK, a significant market for plant-based products. The company's general manager for UK & Ireland, Bryan Carroll, expressed disappointment, noting that the ruling reverses a common-sense decision from the High Court.
