Nebraska Files Antitrust Lawsuit Against PACCAR and Other Truck Manufacturers Over EV Push

The Nebraska Attorney General, Michael Hilgers, filed an antitrust lawsuit on November 19, 2024, against several heavy-duty truck manufacturers, including PACCAR Inc. The lawsuit alleges an industry-wide conspiracy to completely phase out medium and heavy-duty internal combustion engine (ICE) vehicles to comply with California's regulations. The Energy Marketers of America joined the state in alleging that the manufacturers' Clean Truck Partnership agreement with the California Air Resources Board (CARB) is anti-competitive. This agreement is designed to ensure no company benefits from selling more fossil fuel-powered vehicles while others electrify their fleets, potentially driving up prices for ICE vehicles. The suit, filed in Nebraska state court, names Daimler Truck North America, International Motors, PACCAR Inc., Volvo Group North America, and the Truck and Engine Manufacturers Association as defendants. It seeks to void the Clean Truck Partnership agreement nationwide and enjoin the defendants from reducing the output or raising the price of ICE trucks in Nebraska due to the agreement.
