B.C. Government Defends KSM Project's 'Substantially Started' Designation in Court

Seabridge Gold Inc. reported on April 23, 2025, that the British Columbia Government has filed its responses in the BC Supreme Court to petitions challenging the Environmental Assessment Office's (EAO) decision to grant Seabridge Gold's KSM project a 'Substantially Started' (SS) Designation. The SS Designation, issued on July 29, 2024, ensures the project's Environmental Assessment Certificate is no longer subject to expiry.

The BC Government's responses detail the meetings and communications undertaken to fulfill its duty to consult and ensure procedural fairness to the petitioners regarding the SS determination. The government's filings also explain why the granting of the SS Designation was considered reasonable.

A court hearing for these petitions has been scheduled for September 22 to September 29, 2025. Seabridge CEO Rudi Fronk expressed confidence in the strength of the government's arguments, noting that the SS Designation remains in effect while the legal process unfolds.
