KSM Project Tunnel Authorizations Face Third Legal Challenge from Tudor Gold

Seabridge Gold Inc. announced on October 7, 2025, that Tudor Gold Corp. has filed a Petition in the British Columbia Supreme Court. This petition challenges the September 2024 determination by the BC Ministry of Water, Land and Resource Stewardship (WLRS) to grant a Licence of Occupation (2024 LoO) for the KSM Project's Mitchell Treaty Tunnels (MTT) across mineral claims part of Tudor's Treaty Creek Property.

The 2024 LoO provides Seabridge with the right to occupy a narrow corridor for the construction and operation of the MTT, which are two 23 km long parallel tunnels planned to connect the east and west sides of the KSM Project Mine Site. Approximately 12.5 km of the MTT route passes through the Treaty Project Claims.

Tudor is seeking declarations that a Licence of Occupation cannot interfere with mineral claims holders' rights, that provisions granting Seabridge rights across its claims be severed, and an order quashing WLRS's decision. Seabridge Chairman and CEO Rudi Fronk stated that Tudor now has three concurrent legal actions directed at voiding authorizations for the MTT, and expressed confidence in WLRS's decision to support the KSM Project.
