Seabridge Gold Inc. announced on October 3, 2025, that Tudor Gold Corp. has filed a Notice of Civil Claim in the Supreme Court of British Columbia. This action principally challenges the legal effect of the conditional mineral reserve (Reserve) that requires Tudor not to obstruct the construction, operation, or maintenance of the KSM Project's Mitchell Treaty Tunnels (MTT).
Tudor's claim alleges misrepresentation by the Province regarding Tudor's rights as a mineral claims holder and asserts that the Reserve amounts to an expropriation of its mineral claims. Tudor is seeking a court declaration that the Reserve does not apply to it, or that all authorizations for KSM activities on its claims exceed the Province's authority, or compensation for expropriation or damages.
This action is separate from Tudor's appeal of the Chief Gold Commissioner's decision, announced by Seabridge on July 14, 2025. The MTT are two 23 km long parallel tunnels, with approximately 12.5 km of their route passing through Tudor's Treaty Creek Claims. Seabridge expressed confidence in the Province's legal actions and the validity of the MTT authorizations.
