The Australian Competition and Consumer Commission (ACCC) has issued binding rules of conduct to Uniti Group Pty Ltd and its related entities concerning its superfast broadband access service (SBAS). These rules introduce additional regulated terms of access, specifically addressing the number and location of interconnection points for retailers. The ACCC's action follows concerns raised by several retailers regarding the commercial viability of Uniti Group's existing interconnection arrangements.
The ACCC stated that retailers were facing higher supply costs under Uniti Group's commercial charges, prompting the need for regulatory intervention. These binding rules are temporary, with a maximum duration of 12 months, and are intended to enable retailers to supply broadband over Uniti Group networks on reasonable terms.
In conjunction with these temporary rules, the ACCC is commencing a public inquiry to consider varying the SBAS access determination made in March 2024. This inquiry will delve into retailer concerns and other issues related to the price and non-price terms and conditions of access to regulated superfast broadband access services.
